Submitting an order to Promote You Promotional Solutions and your subsequent signature on our order confirmation is a conditional acceptance by Promote You Promotional Solutions of your consent to purchase merchandise from us and confirms your acceptance of our terms and conditions of sale as set forth below. Our customers and Promote You Promotional Solutions agree that any contract entered into shall be interpreted and governed by the laws of British Columbia and Canada.

Promote You Promotional Solutions is required to collect GST/HST in Canada.
Use of Trademarks and Designs
Customers ordering custom-imprinted merchandise for their personal use or on behalf of a company warrants and represents that they are the legal owner or licensee of all rights, including copyright, to each trademark, logo, statement, or any other intellectual property included in the design included in the order to be imprinted on the merchandise you purchase. Moreover, you warrant that the designs provided for reproduction are in accordance with the guidelines of the owner of said trademark or logo.
Customers warrant and represent that no part of the design violates or infringes upon the rights of any person or entity nor is it subject to any restriction or right of any kind or nature whatsoever which would prevent Promote You Promotional Solutions from legally reproducing the images or text.
You agree to defend, at your sole expense, any claim, suit, or proceeding brought against Promote You Promotional Solutions for reproduction of the trademarks, logo or written information you supply to us which constitutes wrongful use of any copyright, trademark, or other right of any third party. Promote You Promotional Solutions shall not be held liable for the unauthorized, improper, or illegal use of any logo or trademark that is applied to promotional merchandise purchased from us. Promote You Promotional Solutions will not accept liability for the actions of clients who have misrepresented their ownership of licenses or trademarks. Further, you agree to indemnify and save Promote You Promotional Solutions harmless from any loss or damage associated with any such claim, suit or proceeding.
Reproduction of Trademarks and Logos on Our Web Site
All items shown on our web site containing corporate logos or registered trademarks are shown only to illustrate the logo reproduction capabilities of the companies that produce the respective merchandise displayed on our site. The illustration of any trademark on our website does not constitute an endorsement by Promote You Promotional Solutions on behalf of the owner of said trademark or design. Product Consistency
We cannot guarantee that all orders purchased through Promote You Promotional Solutions will be 100% consistent in color and material. Minor variations in dye lots, and material thickness and finish are inherent to the manufacturing process. By placing your order with Promote You Promotional Solutions you agree to accept merchandise with such reasonable manufacturing variations.
Transfer of Ownership Merchandise
Our products are sold F.O.B. (freight on board) at the factory or at our facilities. Ownership transfers to the purchaser once the goods are picked up by the carrier.
Shipping Delays
Promote You Promotional Solutions shall not be held responsible for delays in delivery resulting from acts of God or other circumstances beyond our control. Our specified ship dates for your order(s) are based on the representations of the factory where your merchandise is produced. We will not be held liable for any special damages or consequential claims that exceed the invoiced value of the merchandise purchased if merchandise is not shipped on the specified date or is delayed in transit.
Warranties
We warrant that all merchandise sold to you by Promote You Promotional Solutions is free of any security interest. We shall make available all transferable warranties from the manufacturer of the merchandise available to you, the buyer. We do not express or imply any warranties as to the fitness for purpose of the merchandise you purchase from us.
Cancellation and Change Orders
You may cancel your order any time before pre-production starts. Should you cancel your order after the commencement of pre-production, you will be charged a processing fee of $50.00 to cover order processing and art preparation expenses. Once you have approved your artwork, your order will be sent to the manufacturer and production will begin. We may not be able to change or cancel your order once production has started. In addition, you are liable to pay the agreed upon price for any work that may have been completed up to the time that we are able to cancel your order. These charges may include but are not limited to, setup fees, artwork preparation, production, shipping and restocking charges.
Under/Over Runs
Due to the nature of printing and decorating promotional products, small over or under runs sometimes occur. Industry standards are plus or minus 5% of the quantity ordered. We will invoice you for the exact quantity shipped.
Claims, Adjustments & Returns
Except in the case of manufacturing defects, we are unable to accept returns of logoed/custom products. Inspect your merchandise for defects on arrival and contact Promote You Promotional Solutions if you discover any defects. Please contact us prior to returning merchandise. Claims for merchandise damaged in transit must be resolved with the carrier.
In the event that you receive misprinted or incorrect merchandise, please contact us for assistance. Our No Risk Guarantee ensures your complete satisfaction.
Payment Terms
We may grant payment terms after reviewing your credit application. Credit approval is at the discretion of Promote You Promotional Solutions and we reserve the right to refuse credit to anyone for any reason. A service charge may be assessed on all past due balances at the rate of 1.5% per month.
Returned Cheques
We charge $50.00 for cheques returned NSF (non-sufficient funds).
